A major Virginia cannabis operator is taking legal action against some big-name retailers. Jushi Holdings Inc. has filed a lawsuit against DoorDash, Total Wine, and several other companies, accusing them of selling illegal hemp THC products that exceed the state’s legal THC limits.
The lawsuit, filed in Arlington County Circuit Court, claims these businesses have been promoting high-potency cannabinoid products as legal “hemp,” even though they allegedly meet the criteria for illegal marijuana under Virginia law.
According to the complaint, these products were sold without required testing, safety checks, or regulatory oversight, giving unlicensed sellers an unfair advantage over Virginia’s regulated medical cannabis program. Jushi argues that this “deceptive” marketing has flooded the market with unregulated products that mislead consumers.
The case highlights a growing conflict nationwide: the battle between regulated cannabis businesses and the fast-moving hemp-derived THC industry, which often operates with fewer rules. The outcome could influence how Virginia—and potentially other states—police the line between legal hemp products and illegal marijuana.
